The terms on which we provide our information service. By using this site or requesting a check, you agree to these terms.
The service
Property Assurance is an independent Australian information service. A check reads public licence, company and insurance registers and returns a plain, cited report of what those registers held at the time we read them. We are not a government body, a regulator, an insurer or a credit provider, and we are not affiliated with any builder or developer.
What the report is, and is not
A report is information, not legal or financial advice, and it is not a recommendation. It describes the public record at a point in time; records change, so each line is timestamped to the date it was retrieved. We do not rate, rank or characterise any named business.
Acceptable use
You may use this site and our reports for your own lawful, personal or business purposes. You may not misrepresent a report, or use the service in a way that breaches any law or infringes the rights of others.
You must not scrape, crawl, harvest, bulk download or otherwise systematically extract the pages, data or compiled listings on this site, whether by automated means or otherwise, and you must not copy, republish, redistribute, resell or build a competing or derivative dataset or directory from them. Access is licensed for ordinary, page-by-page human use only. We do not offer a bulk export, and using the site in a manner that imposes an unreasonable load, evades rate limits or circumvents access controls is prohibited.
No warranty
We compile reports from primary public sources with care, but we do not warrant that a register is complete, current or free of error at the moment you rely on it. To the extent permitted by law, the service is provided on an “as is” basis without warranties of any kind.
Limitation of liability
To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, our liability arising from your use of the service is limited to resupplying the report or refunding the fee paid for it.
Intellectual property
Individual facts in the public registers belong to their respective sources, which we cite, and are not ours to own. But the way we bring them together is. Our selection, arrangement and presentation of that data into pages, listings and reports is an original compilation, and the explanatory and editorial text we write around it (our headings, summaries, guides and page copy) is original authorship. Both are protected by copyright and are owned by Property Assurance. The site, its design and the format of our reports are also our intellectual property. You keep the report we prepare for you for your own use; that does not transfer ownership of the compilation or our original text.
Governing law
These terms are governed by the laws of New South Wales, Australia [jurisdiction (New South Wales or Queensland) to be confirmed on legal review], and you submit to the non-exclusive jurisdiction of the courts of that state.
